Welcome to Stimulus. By downloading, installing, or using the Stimulus application ("App"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.
1. Acceptance of Terms
By accessing or using Stimulus, you agree to these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the App.
2. Description of Service
Stimulus is a behavioral screen time management application that helps users balance their app usage through a stimulation points system. The App:
- Tracks and manages screen time for apps you designate as high-stimulation
- Integrates with Apple HealthKit to convert physical activity into points
- Allows you to earn points through healthy app alternatives
- Applies shields to draining apps when your points balance is depleted
- Provides insights and visualizations about your usage patterns
3. Eligibility
You must be at least 13 years old to use Stimulus. If you are under 18, you represent that you have your parent or guardian's permission to use the App.
4. Account & Data
Stimulus does not require an account. All your data is stored locally on your device. You are responsible for maintaining the security of your device and any data stored on it.
5. Subscriptions & Payments
5.1 Subscription Options
Stimulus offers the following subscription options:
- Monthly: $6.99 per month
- Yearly: $59.99 per year (save 29%)
Both options include a 3-day free trial for new subscribers.
5.2 Billing
All payments are processed through Apple's App Store. Your subscription will automatically renew unless cancelled at least 24 hours before the end of the current billing period.
5.3 Cancellation
You may cancel your subscription at any time through your Apple ID account settings. Cancellation will take effect at the end of the current billing period. No refunds are provided for partial subscription periods.
5.4 Price Changes
We reserve the right to change subscription prices. Any price changes will be communicated in advance and will apply to subsequent billing periods.
6. Acceptable Use
You agree not to:
- Attempt to circumvent, disable, or interfere with the App's functionality
- Reverse engineer, decompile, or disassemble the App
- Use the App for any illegal purpose
- Share your subscription access with others
- Attempt to access features or content you haven't paid for
7. Health & Medical Disclaimer
Important: Stimulus is a behavioral tool, not a medical device. The "stimulation points" system is a simplified behavioral model to help visualize stimulation levels - it does not measure actual neurotransmitters or brain chemistry.
Stimulus is not intended to diagnose, treat, cure, or prevent any medical condition, including but not limited to addiction, ADHD, anxiety, or depression. If you have concerns about your screen time habits or mental health, please consult a qualified healthcare professional.
The App's use of health data (steps, exercise minutes, workouts) is for gamification purposes only and should not be considered medical advice or a substitute for professional health guidance.
8. Intellectual Property
The App, including its design, features, content, and underlying code, is owned by Stimulus and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.
9. Third-Party Services
Stimulus integrates with:
- Apple HealthKit: Subject to Apple's terms and your device permissions
- Apple Screen Time API: Subject to Apple's FamilyControls framework requirements
- Apple App Store: For processing all purchases and subscriptions
- Superwall: For paywall presentation and subscription management
We are not responsible for the availability, accuracy, or reliability of these third-party services.
10. Limitation of Liability
To the maximum extent permitted by law:
- Stimulus is provided "as is" without warranties of any kind
- We do not guarantee that the App will be error-free or uninterrupted
- We are not liable for any indirect, incidental, special, or consequential damages
- Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim
11. Indemnification
You agree to indemnify and hold harmless Stimulus and its affiliates from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.
12. Modifications to Terms
We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App or on our website. Your continued use of the App after changes constitutes acceptance of the modified Terms.
13. Termination
We may terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
You may terminate your use of the App at any time by uninstalling it from your device and cancelling any active subscription.
14. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
15. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
16. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Stimulus regarding the use of the App.
